1. Acceptance of Terms
By accessing or using MCPNest (mcpnest.io), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms constitute a legally binding agreement between you and MCPNest (operated by Ricardo Rodrigues, Portugal).
2. Description of Service
MCPNest is a marketplace and registry for Model Context Protocol (MCP) servers. We provide: - Discovery and search of MCP servers - Installation instructions and configuration - A platform for developers to publish MCP servers - Subscription plans for enhanced features
3. User Accounts
To publish MCP servers or access premium features, you must create an account via GitHub OAuth. You are responsible for: - Maintaining the security of your account - All activity that occurs under your account - Ensuring your GitHub account complies with GitHub's terms - Providing accurate information You must be at least 16 years old to create an account.
4. Intellectual Property
MCPNest Platform: All code, design, branding, logos, and content of the MCPNest platform are owned by Ricardo Rodrigues and protected by copyright law. You may not copy, reproduce, distribute, or create derivative works without explicit written permission. MCPNest Brand: The name "MCPNest", the logo (two-arc circle design), and associated branding are proprietary. You may not use them without written permission. User Content: When you publish an MCP server on MCPNest, you retain ownership of your code. You grant MCPNest a worldwide, non-exclusive, royalty-free license to display, index, and distribute information about your MCP server on our platform. Third-Party Content: MCP servers listed on MCPNest are owned by their respective creators. MCPNest does not claim ownership of third-party MCP servers.
5. Publisher Rules
When publishing MCP servers, you agree that your submission: - Does not infringe any third-party intellectual property rights - Does not contain malware, spyware, or malicious code - Does not collect user data without explicit consent - Does not violate any applicable laws - Accurately describes the server's functionality and permissions - Does not impersonate other projects or organizations MCPNest reserves the right to remove any MCP server that violates these rules without notice.
6. Prohibited Uses
You may not use MCPNest to: - Violate any applicable law or regulation - Infringe intellectual property rights of others - Distribute malware or malicious code - Attempt to gain unauthorized access to our systems - Scrape or harvest data without permission - Impersonate MCPNest or other users - Spam or send unsolicited communications - Engage in any fraudulent activity
7. Payments and Subscriptions
Payments are processed by Stripe. By subscribing to a paid plan, you agree to: - Pay the applicable fees as described on our Pricing page - Provide accurate billing information - Authorize recurring charges for subscription plans Refunds: We offer a 14-day money-back guarantee for first-time subscribers. After 14 days, payments are non-refundable except as required by law. Cancellation: You may cancel your subscription at any time. Your access continues until the end of the current billing period. Price Changes: We will notify you at least 30 days before any price changes.
8. Disclaimer of Warranties
MCPNest is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that: - The service will be uninterrupted or error-free - MCP servers listed are secure, accurate, or fit for purpose - Results obtained from using the service will be accurate We are not responsible for the functionality, security, or legality of third-party MCP servers listed on our platform.
9. Limitation of Liability
To the maximum extent permitted by Portuguese and EU law, MCPNest shall not be liable for: - Indirect, incidental, or consequential damages - Loss of data, profits, or business - Damages arising from use of third-party MCP servers - Any damages exceeding the amount you paid us in the last 12 months This limitation applies regardless of the legal theory (contract, tort, strict liability, etc.).
10. Indemnification
You agree to indemnify and hold harmless MCPNest and its operators from any claims, damages, or expenses (including legal fees) arising from: - Your use of the service - Your violation of these terms - Your violation of any third-party rights - MCP servers you publish on the platform
11. Termination
We may suspend or terminate your account at any time if you violate these terms. You may delete your account at any time by contacting malasartes@mcpnest.io. Upon termination, your right to use the service ceases immediately. We may retain certain data as required by law.
12. Governing Law
These terms are governed by the laws of Portugal and the European Union. Any disputes shall be resolved in the courts of Portugal. As a consumer in the EU, you may also have rights under local consumer protection laws.
13. Changes to Terms
We may update these terms. We will notify you by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the new terms.
